Alternative Dispute Resolution

Paley Rothman’s Alternative Dispute Resolution (ADR) practice group offers clients a variety of cost-efficient alternatives to the traditional litigation process. Our attorneys are highly skilled at resolving personal and business disputes, often before formal litigation has begun.

Alternative dispute resolution is a private, informal process intended to help disputing parties achieve a satisfactory resolution without going through a court trial. To meet that objective, our attorneys provide clients with settlement assistance prior to initiating litigation, as well as advice on mediation, arbitration and other ADR alternatives to court litigation. If litigation has already begun, we are often able to apply our resolution skills to bring the case to a faster conclusion.

The members of this practice group have extensive experience in a variety of ADR techniques such as mediation, arbitration, mini-trials and neutral case evaluation, among others. Trish Weaver, the chair of this practice group, serves as both a court-appointed mediator and a member of the American Arbitration Association’s Commercial Panel of Neutrals (Arbitration) and Panel of Mediators. Each of our ADR attorneys has received specialized training in mediation, arbitration or ADR advocacy and counseling, and all actively serve as court-appointed mediators, ADR neutrals or counselors. The hands-on experience of our ADR attorneys as active mediators and arbitrators is coupled with years of experience representing clients in ADR proceedings. This combination of skills provides our clients with invaluable insights learned from all sides of the ADR process. Our collective ADR capabilities along with our extensive litigation experience enables us to recognize the strengths and shortcomings of cases as they move through the often confusing processes of litigation and alternative dispute resolution.

The ADR practice group regularly draws upon attorneys from Paley Rothman’s other practice areas to provide solutions that address all aspects of our clients’ complex personal and business-related legal problems.
