Employment Law attorney, Scott Mirsky, led a roundtable discussion for the Association of Language Companies titled, “Roundtable: Exemption, Exemption, Exemption! Can LSCs in California meet the requirements to reap the benefits of the new exemption and avoid the strict ABC test for employee/contractor classification?”
Last month, after extensive lobbying efforts by the language services industry, the California legislature provided some needed relief from the strict ABC Test used for employee/contractor classification. The language services industry was included in the legislation and translation services received a clear exemption from the strict ABC Test. However, for LSCs who provide interpretation services in California, they will have to meet numerous additional requirements to reap the benefits of the new legislation. Scott led an open discussion about these requirements and discussed if these requirements can be satisfied by LSCs.
